TERMS AND CONDITIONS

Article 1. General

1.1 Identification of the organization

The services and products mentioned on this website are offered by JMD Events VZW, operating under the name Ford Performance Club Belgium Luxembourg (hereinafter referred to as “Ford Performance Club”).

1.2 Scope of application

These general terms and conditions apply to the use of the website www.fordperformanceclub.eu and to all services, activities, and products offered or organized through this website by Ford Performance Club. By using this website or making use of our services, you fully and unconditionally agree to these terms and conditions.

1.3 Definitions

For the purpose of these terms and conditions, the following definitions apply:

  • “Customer”: the natural person or legal entity making use of the services or products of Ford Performance Club.
  • “Organization”: JMD Events VZW, operating under the name Ford Performance Club Belgium Luxembourg.
  • “Website”: the online environment accessible via www.fordperformanceclub.eu and all associated subpages.
1.4 Acceptance of the terms

By placing an order, registering for an activity through the Organization’s website, or using the website, the Customer declares to have read, understood, and unconditionally accepted these general terms and conditions. If you do not agree with (any part of) these terms and conditions, you are requested not to use our website, services, or activities.

Article 2. Website and linked platforms

2.1 Ownership and use

The content of this website and the information provided on it (including but not limited to images, logos, texts, trademarks, etc.), as well as the underlying system through which this content and information are made available, are the property of JMD Events VZW, operating under the name Ford Performance Club Belgium Luxembourg, or of its partners.

 

You agree not to use this website, including all content and information, for unlawful, commercial, or non-personal purposes.


It is therefore prohibited, without the express written consent of Ford Performance Club, to make references to this website for the promotion of your own commercial activities. You must contact info@fordperformanceclub.be to obtain permission for advertising, marketing, or any other commercial use.

 

You undertake not to modify, copy, distribute, transmit, display, reproduce, publish, license, create derivative works from, transfer, or (re)sell any information, routes of offered tours, products, files, or services obtained through this website, either in whole or in part.

2.2 Intellectual property

This website and the linked platforms are trademarks and intellectual property of JMD Events VZW / Ford Performance Club Belgium Luxembourg. Brand names, product names, services, or company names mentioned or displayed on this website are protected by intellectual-property rights belonging to Ford Performance Club or to the respective owners and partners of the Organization.

 

The name “Ford”, the Ford oval logo, and the designation “Ford Performance” are registered trademarks and intellectual property of Ford Motor Company or its subsidiaries. JMD Events VZW, operating under the name Ford Performance Club Belgium Luxembourg (hereinafter “Ford Performance Club”), is licensed by Ford Motor Company to use these trademarks in the context of its club activities, communication, and promotion. Ownership of these trademarks remains exclusively with Ford Motor Company. Nothing in these general terms and conditions shall be construed as a transfer or waiver of Ford Motor Company’s intellectual-property rights to Ford Performance Club or any third party.

2.3 Content and accuracy of information

The content of this website has been compiled with the greatest possible care and is regularly updated. However, Ford Performance Club cannot guarantee that the information is at all times complete, accurate, or up to date. The user accepts this and acknowledges that no guarantee is given regarding the accuracy or completeness of the information provided. The website and its contents are provided “as is”, without any explicit or implied warranty.

2.4 Liability

Under no circumstances shall Ford Performance Club be liable for any direct or indirect damage arising from the use of, or inability to use, this website or the platform, nor for any information, products, or services mentioned thereon. This applies regardless of whether the damage is based on contractual fault, tort, strict liability, or any other legal basis, even if Ford Performance Club was previously informed of the possibility of such damage.

2.5 External links

This website may contain hyperlinks to third-party websites or external sources. Such links are provided solely for the user’s information. Ford Performance Club has no control over the content of these external websites and accepts no responsibility or liability for their content, availability, or operation.

2.6 Access and technical aspects

Ford Performance Club strives to keep the website continuously accessible and functional, but cannot guarantee that the website will at all times be free from interruptions, malfunctions, or errors. The Organization reserves the right to temporarily or permanently suspend access to the website for maintenance, updates, or other reasons, without prior notice and without any right to compensation.

2.7 Unauthorized use

It is prohibited to use the website or the name Ford Performance Club in any manner that may cause harm to the Organization, its reputation, or third parties. Any breach of this provision may give rise to legal action.

Article 3. Obligations of the Customer

3.1 Principal and payment

The customer who registers for an event or subscribes for membership via the website or the member portal of Ford Performance Club is considered the principal and is responsible for the full payment of the order or registration, even when it is carried out or paid for on behalf of third parties.

 

When a registration is made by one person for multiple participants, that person is deemed to represent the entire group and remains jointly and severally liable for the correct fulfillment of all obligations.

3.2 Participation requirements

To participate in events where the customer acts as the driver of a vehicle, the customer must be at least 18 years old and hold a valid driver’s license. Passengers or accompanying persons are not required to meet these conditions. The customer is solely responsible for ensuring that he or she meets these conditions at the time of registration and at the time of participation. Additional participation requirements may be stated on the event’s web page.

 

To become a member of Ford Performance Club, the customer must be at least 16 years old or have written consent from parents or legal guardians.

3.3 Accuracy of personal data

The customer is solely responsible for any errors or omissions during the purchase or registration process, including incorrect entry of personal data, email address, or product selection. The customer is also responsible for the proper functioning, security, and accessibility of his or her own email program.

 

The customer undertakes to provide accurate, current, and complete personal data for each registration, order, or sign-up on the website or via the member portal. Ford Performance Club reserves the right to refuse or cancel orders or registrations if there are indications of incorrect data, misuse, or fraud.

 

A permanent email address is required for registration. The use of temporary or disposable email addresses is expressly prohibited. Disposable addresses are reassigned to other users once discarded, potentially giving unauthorized persons access to the participant’s account.

3.4 Retention of confirmation proof

After payment of an order on the website, the customer will receive a digital order confirmation via email. This confirmation serves as valid proof of registration for the selected event. The risk of loss or incorrect delivery of digital documents or emails (for example due to incorrectly entered data or technical issues) lies entirely with the customer from the moment the email is delivered to the customer’s email provider. The same principle applies to email communications regarding the activation or renewal of membership.

Article 4. Membership

4.1 Price and fees

The membership fee amounts to €35 (thirty-five euros) per year, including VAT. Shipping costs for sending a membership card may apply depending on the destination (for example, for shipping outside Europe). The applicable shipping costs are always stated on the member portal before payment. Ford Performance Club reserves the right to adjust the membership fee or shipping costs in the future. Any price changes will be clearly communicated to members in advance.

4.2 Membership registration process

Membership with Ford Performance Club can only be requested through the official member portal of Ford Performance Club. During the registration process, the various steps are clearly explained. The customer can always review and correct the order and entered data before completing payment. A registration becomes final only after full payment has been successfully completed and the customer has received a confirmation via email.

 

Registrations not made through the official website or member portal of Ford Performance Club are invalid and do not entitle the customer to membership.

4.3 Duration and renewal of membership

A membership is valid for one (1) year, corresponding to a period of three hundred sixty-five (365) days, unless explicitly stated otherwise. Ford Performance Club will inform the customer in due time about the upcoming renewal of the membership.

 

Upon expiration, membership may be renewed:

  • either automatically via direct debit, if the customer has explicitly opted for it;

  • or manually, via regular payment after receiving a reminder by email.

 

In the case of automatic renewal, the customer always retains the right to terminate the membership before the charge for the next period, subject to the applicable notice period.

 

If the customer does not renew or if the direct debit cannot be processed, the membership automatically expires on the end date, and the associated member rights and benefits are temporarily suspended until a new payment is received.

4.4 Content of membership

Membership of Ford Performance Club grants the customer access to:

  • the member portal of Ford Performance Club;
  • club communication and newsletters;
  • events and exclusive activities; and
  • various benefits reserved exclusively for members (see Article 5).

 

The nature and scope of these benefits may periodically be changed or supplemented by Ford Performance Club, without giving rise to reimbursement or compensation.

4.5 Membership card and delivery

The physical membership card of Ford Performance Club is sent by post to the address provided by the customer during the registration or renewal process. Ford Performance Club aims for delivery within seven (7) working days, unless a different period is explicitly stated during registration (for example, for shipments outside Europe).

 

During the registration process, the membership card is offered by default, but the customer may opt not to receive a physical membership card. In that case, no shipping costs are charged.

 

Ford Performance Club is not liable for loss or delay of membership cards during postal delivery, nor for errors resulting from an incorrect or incomplete address provided by the customer.

 

In case of loss, damage, or theft of the membership card, the customer may request a replacement card by contacting Ford Performance Club at info@fordperformanceclub.be. Administrative and shipping costs may be charged for reissuing and sending a replacement card. The amount of these costs is determined by Ford Performance Club and communicated to the customer in advance.

4.6 Proof of membership

An active customer account on the member portal of Ford Performance Club constitutes the only official proof of membership with the organization. The member portal displays the current membership status and validity period.

 

The physical membership card provided to the customer is for informational and representative purposes only. It cannot be considered proof of active membership and does not, by itself, grant access to events, member benefits, or club activities.

 

In the event of doubt or verification, only the membership status as recorded in the member portal shall be considered binding and legally valid.

Article 5. Member Benefits

5.1 The benefits

On the member portal of Ford Performance Club, discounts and prize promotions are presented to which members are entitled based on their active membership.

 

These benefits may relate to:

  • the products, services, and events of Ford Performance Club itself; and/or
  • the products, services, or promotions of partners with whom Ford Performance Club cooperates.

 

The specific conditions, duration, and validity of each benefit or promotion are clearly explained on the corresponding page within the member portal. Discounts or other advantages may be provided through a unique code, an automatically generated code, or a unique URL where the discount is applied automatically.

5.2 Acceptance of conditions

By using a discount, promotion, or prize action, the member expressly agrees to:

  • the general terms and conditions of Ford Performance Club;

  • where applicable, the terms and conditions of the relevant partner; and

  • the specific action conditions stated on the benefit or promotion page.

 

As soon as the member leaves the website or member portal of Ford Performance Club, the organization is no longer responsible for the execution of the promotion, the quality of the offer, or the correct application of the discount. The execution of partner promotions falls under the exclusive responsibility of the respective partner. However, Ford Performance Club will assist members in the event of problems by contacting the relevant partner directly.

5.3 Terms and restrictions of use

The personal login credentials of the member portal grant only the registered member the right to use the platform and its associated benefits. The member undertakes to treat these credentials, as well as any access codes or discount codes, as confidential and to actively prevent misuse.

 

The instructions relating to benefits are clearly indicated in the member portal. These benefits are intended exclusively for members with an active membership.

 

Products or services obtained through member benefits may not be resold or used for commercial purposes. In particular, it is prohibited to resell products or services purchased with member discounts or promotions via online marketplaces, auctions, or similar platforms. Any violation of this provision may result in the immediate suspension or permanent termination of membership and possible legal proceedings.

5.4 Prohibition on transfer of benefits

Membership benefits, including discount codes, promotional URLs, or access to offers, may not be shared, transferred, or disclosed to third parties. The sharing or dissemination of such data is considered misuse or theft and may result in legal action as well as the immediate suspension or permanent termination of membership.

Article 6. Registration and Access to Events

6.1 Prices and fees

All prices stated on the Ford Performance Club website include, unless expressly stated otherwise, all costs related to registration, processing, and participation in the event. Any additional costs, such as shipping costs for physical membership cards or administrative fees, will be clearly stated before the confirmation of the order. All prices include VAT and any applicable taxes, unless explicitly stated otherwise.

6.2 Event registration process

Registrations for events take place exclusively via the official website of Ford Performance Club. During the registration process, all steps are clearly explained. The customer can review and correct the order and entered information before completing the payment. A registration becomes final only after full payment has been successfully completed and the customer has received a digital order confirmation via email.

 

Registrations that are not placed through the official website or member portal of Ford Performance Club are invalid and do not entitle the participant to entry.

6.3 Confirmation and delivery

After payment of a registration, the customer receives a digital order confirmation by email. This confirmation serves as valid proof of registration for the selected event. The digital confirmation is sent to the email address provided by the customer upon registration. From the moment this email is delivered to the customer’s email provider, the risk of loss, incorrect delivery, or technical issues lies entirely with the customer.

 

If the customer does not receive the order confirmation within four (4) working days after payment—or (if the registration took place within four days prior to the event) at the latest one (1) working day before the start of the event—the customer must immediately contact Ford Performance Club via info@fordperformanceclub.be. In such case, the original confirmation may be invalidated and a new one issued. Processing delays do not entitle the customer to any compensation, interest, or refund.

6.4 Proof of participation

The digital order confirmation constitutes the official proof of registration and grants access to the event. The customer must be able to present this proof at the event entrance. If printed, the confirmation must be clearly legible; unclear or damaged prints may result in refusal of entry. Each confirmation corresponds to a single admission registration.

Article 7. Participation in Events

7.1 General provisions

Participation in events organized by Ford Performance Club is entirely at the participant’s own risk. By registering for an event, the participant declares to have read and agreed to the provisions of this article and the applicable safety and conduct rules.

 

Participants undertake to always follow the instructions of the organization or its representatives.

 

The organization may refuse or terminate participation if the participant fails to comply with these provisions or behaves irresponsibly during the event. Misconduct, recklessness, or obstructing other participants may also result in immediate exclusion without refund.

7.2 Participation with own vehicle

Each participant taking part with his or her own vehicle must act responsibly and, during the event, comply with the following rules:

  1. The participant must hold valid liability insurance (BA) and all legally required documents. The vehicle used must be technically sound and comply with all applicable safety and traffic regulations. The organization reserves the right to refuse participation if the vehicle is clearly unsafe or non-compliant.

  2. The participant agrees to comply with all traffic rules and police regulations, including speed limits, seatbelt requirements, alcohol and mobile-phone use laws. Any fines or violations during the event are solely at the participant’s expense and cannot be recovered from Ford Performance Club.

  3. The events or tours organized by Ford Performance Club are not competitions or rallies. Racing or any behavior endangering others is strictly prohibited. This is also stated in writing in every roadbook provided by Ford Performance Club. The route offered by the organization is purely indicative and informational and does not bind the organization in any way.

  4. The participant does so entirely at his or her own responsibility and risk. Ford Performance Club and its staff or volunteers cannot be held liable for any damage, accident, injury, loss, or theft, regardless of cause. This exclusion applies to the driver and passengers as well as to third parties.

  5. In the event of an accident or breakdown, the participant remains fully responsible for the vehicle and any resulting damage. Even during roadside assistance, the participant remains responsible for the vehicle and for any damage arising during the assistance process. Ford Performance Club can in no way be held liable for this.
7.3 Participation with a vehicle provided by the organization

Each participant taking part with a vehicle provided by Ford Performance Club or a partner organization (for example, during a driving-skills training) must act responsibly and comply with the following rules during the event:

  1. The participant remains fully responsible for the correct and safe handling of the vehicle. The participant shall use the vehicle with due care and solely for the purposes of the event.

  2. Any damage to the vehicle resulting from improper use, negligence, or violation of instructions may be recovered from the participant. Ford Performance Club is not liable for personal injury, damage, or loss caused by or during the use of the provided vehicle.

  3. If the vehicle is insured by the organization, such insurance only covers legal third-party liability within the limits of the policy. Damage under the deductible, intentional misconduct, or violations are not covered and remain the participant’s responsibility.

7.4 Participation as an individual

Participants without a vehicle (such as passengers, guests, or participants in non-driving activities) also take part at their own risk. Ford Performance Club is not liable for any injury, loss, or damage to personal belongings that may occur during the event.

Article 8. Force Majeure

8.1 Definition

Ford Performance Club shall not be liable for any failure to fulfill its obligations, or for any damage arising therefrom, if such failure results from force majeure or circumstances beyond its reasonable control.

 

For the purposes of these terms and conditions, force majeure includes (but is not limited to): natural disasters, pandemics, epidemics, war, terrorism, fire, explosion, flooding, exceptional weather conditions, government measures, strikes, blockades, technical failures, electricity or internet outages, delays in transport or delivery, illness or accident involving relevant staff members, or any other event that cannot reasonably be attributed to Ford Performance Club.

8.2 Consequences of force majeure

In the event of force majeure, Ford Performance Club has the right to:

  • temporarily suspend the performance of its obligations;

  • modify, postpone, or cancel the agreement or participation; or

  • offer an alternative solution, such as a rescheduling, voucher, or later execution, without any entitlement to compensation.

 

The participant or customer acknowledges that such circumstances do not give rise to any right to refund or additional compensation, unless explicitly decided otherwise by Ford Performance Club.

Article 9. Cancellation and Right of Withdrawal

9.1 Cancellation by the customer

Registrations for events or activities organized by Ford Performance Club are in principle final and are non-refundable, even in the case of incorrect booking, loss, or non-participation by the customer.

 

A refund or compensation can only be requested if the customer has selected the optional cancellation insurance offered by Ford Performance Club at the time of registration.

 

The conditions of this insurance are as follows:

  • The cancellation insurance entitles the customer to a voucher equal to the paid registration amount, excluding the cost of the cancellation insurance itself.
  • The amount of this insurance fee is determined by Ford Performance Club.
  • A cancellation may only be requested up to seven (7) days before the event start date. After this deadline, cancellation or refund is no longer possible.
  • If no cancellation insurance option is offered for a specific event, no refund can be requested.

 

In exceptional circumstances, Ford Performance Club may, at its sole discretion, decide to grant a partial or full cancellation. This decision lies entirely with the organization and not with the customer.

9.2 Cancellation by the organization

Ford Performance Club reserves the right to modify, postpone, or cancel an event, activity, or part thereof in case of unforeseen circumstances, including but not limited to: insufficient registrations, safety reasons, illness of involved staff, or other forms of force majeure as described in Article 8.1.

 

In the event of cancellation by Ford Performance Club, the participant is always entitled to a full refund of the paid amount, including the possible cost of cancellation insurance.

 

If the participant does not request a refund, Ford Performance Club may, at its own discretion:

  • transfer the registration free of charge to the next edition of the same event (provided it is offered at the same price), or

  • issue a voucher equal to the paid amount, which may be used for another event organized by Ford Performance Club.

 

These compensations are considered full and sufficient settlement. Ford Performance Club reserves the right to deviate from this in cases of force majeure.

 

The participant is not entitled to any additional compensation or interest, and Ford Performance Club is not liable for indirect damage or costs resulting from the cancellation or modification of the event, such as travel expenses, hotel costs, leave days, or other personal expenses.

9.3 Exclusion of right of withdrawal for events

In accordance with Article VI.53, 12° of the Belgian Code of Economic Law and Article 16, (l) of Directive 2011/83/EU on consumer rights, the customer has no right of withdrawal (the legal 14-day cooling-off period) for registrations relating to events or activities taking place on a specific date or within a specific period.

 

The customer acknowledges and accepts that each registration is immediately final upon payment, and that only the provisions regarding the optional cancellation insurance, as described in Article 9.1, apply.

9.4 Exclusion of right of withdrawal for memberships

Memberships of Ford Performance Club grant the customer immediate access to digital and organizational services, including the member portal, club communications, and exclusive benefits.

 

In accordance with Article VI.53, 1° and 13° of the Belgian Code of Economic Law and Article 16, (a) and (m) of Directive 2011/83/EU on consumer rights, the customer has no right of withdrawal (the legal 14-day cooling-off period) once the performance of the membership has begun with his or her express consent.

 

By expressly accepting the general terms and conditions followed by payment of the membership fee and activation of the membership, the customer declares that:

  • the execution of the service may start immediately, and
  • he or she waives the right of withdrawal once the execution has begun.

 

Therefore, the membership is immediately final upon payment and cannot be cancelled or refunded.

Article 10. Payments

10.1 Payment methods

The products and services of Ford Performance Club can only be paid for via the online payment methods available on the website or within the member portal. Payments are securely processed through the recognized payment platform Mollie Payments.

 

Depending on the country and availability, the customer may pay using:

  • Bancontact,

  • SEPA Bank Transfer, or

  • • payment cards (credit or debit) supported by Mollie.

 

All payments are made in euros (EUR), unless explicitly stated otherwise during the purchase process. The customer is responsible for any fees or currency exchange charges imposed by their financial institution.

10.2 Payment conditions

All purchases must be paid in full and immediately. The order, registration, or activation of membership is only considered final after receipt of full payment. If payment is not (timely) completed, Ford Performance Club may refuse or cancel the order or registration, without the customer being entitled to compensation or participation.

10.3 Proof of payment and invoicing

After successful payment of an order via the official website of Ford Performance Club, the customer receives a digital order confirmation by email. This confirmation serves as proof of payment.

 

Invoices are not issued automatically but can be provided upon simple request by contacting Ford Performance Club at info@fordperformanceclub.be. Invoices are only issued if the customer provides the necessary billing details correctly and completely with the request.

10.4 Right to refuse payment

Ford Performance Club reserves the right to refuse, block, or cancel orders or payments in the event of:

  • incomplete or incorrect payment,

  • indications of fraud or misuse, or

  • suspected non-compliance with these general terms and conditions.

 

In such cases, Ford Performance Club may request additional verification or proof of identity before confirming the order.
